These Terms and Conditions, along with Privacy Policy and other terms (“Terms”) constitute a binding agreement by and between Underrated Club, a brand under KINGSCRAFT ONLINE BRANDS PRIVATE LIMITED, (“Website Owner” or “we” or “us” or “our”) and you (“you” or “your”) and relate to your use of our website, goods (as applicable) or services (as applicable) (collectively, “Services”).

You understand that upon initiating a transaction for availing the Services you are entering into a legally binding and enforceable contract with us for the Services.

You shall be entitled to claim a refund of the payment made by you in case we are not able to provide the Service. The timelines for such return and refund will be according to the specific Service you have availed or within the time period provided in our policies (as applicable). The money shall be credited to you in the form of store credits/ vouchers, or back to source account (if you have paid on COD basis, this would automatically be credited in the form of store credits/voucher, not in the bank account),

You shall be responsible for payment of all fees/costs/charges associated with the purchase of good and services from us and you agree to bear any and all applicable taxes including but not limited to VAT/CST, Service Tax, GST, duties and cesses etc.

As required by applicable law, if you make a purchase of an amount equal to or above Rs. 2,00,000.00/- (Rupees Two Lakhs) then you shall upload a scanned copy of your PAN card on the website, failing of which, the order made by you will be cancelled. The requirement to submit the PAN card arises only once and if it has been submitted already by you, it need not be submitted again. The order shall stand cancelled if there is a discrepancy between the name of the Customer and the name on the PAN Card.

Notwithstanding anything contained in these Terms, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event.

These Terms (including the Privacy Policy) and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in PUNE CITY, Maharashtra

Use of the website and its services is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. If you are a minor i.e. under the age of 18 years, you may purchase the good and services only with the involvement of a parent or guardian.

If you breach the terms and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

You shall indemnify and hold harmless KINGSCRAFT ONLINE BRANDS PRIVATE LIMITED, its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of your breach of this Terms of Use, privacy Policy and other Policies, or your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.
